It seems highly likely that SCOTUS will eventually knock down the Presidents Section 122 tariffs as the rational for using Section 122 does not exist.
Section 122, sub-paragraph (a) requires the existence of a “fundamental international payments problem”
There is a no fundamental international payments problem. There is a trade balance deficit problem. They are not the the same thing, so logic suggests any tariffs under Section 122 will eventually go the same way as Reciprocal Tariffs. The USA has a system for implementing tariffs, though Congress, that is legal. I hope any furutre tariffs are implemented though the legally mandated system, rather than though dubious interpretations of laws meant for other situations.
To be clear, like everyone else, i don’t like tariffs, but at the same time, i understand we do need tariffs or something similar, else manufacturing in democracies will cease to exist. If that happens we would be at the mercy of countries that can manufacture, whether it be drugs, food or materials. We will have sold out our independence for “cheap”. Countries run by dictators or unelected parties ( ie by controlling any opposition ) can think long term and make long term strategies. Democratic countries leaders tend to think for their term in office, selling their own country out for short term gains. We need to start thinking longer term and find ways to make long term strategic goals.
